HSE: Forthcoming Regulations in 2006

In February 2005, the HSE decided to implement changes that arise from within the UK on only two dates each year. In implementing these scheduled dates their hope is that those affected (ie businesses, employee representatives and individuals) will be more aware of forthcoming changes and better able to plan for and implement new measures effectively.

One of the changes that is due to come into effect on 6 April 2006 affect the Management of Health and Safety at Work and Health and Safety (Consultation with Employees)(Amendment) Regulations and is as follows:

‘Proposed amendment of Regulation 22 of the Management of Health and Safety at Work Regulations 1999 to exclude the right of third parties to seek damages from employees in breach of their duties under these regulations.’

Full details of regulations that are due to commence during 2006 can be found on the HSE website at www.hse.gov.uk. The HSE intend to update it every six months, covering a rolling 12-month period.
